Surrogacy Legislation

In 2010, the NSW Parliament passed new laws governing surrogacy. The new laws are now in force and will likely affect you, your child, and your surrogacy arrangement.

The good news is that the new laws will make it easier for you to be recognised as the parents of your child. You will still need to satisfy a number of legal requirements, however the process appears to be relatively simple and ‘more natural’ than the previous legal framework (or lack of), which essentially requires you to adopt your child. Fortunately, the new laws will also apply retrospectively to pre-existing surrogacy arrangements including yours.
